Plain English Definition

A private dispute resolution method where both parties agree to have their case decided by an independent arbitrator instead of going to court. Governed by the Arbitration and Conciliation Act, 1996 in India. The arbitrator's decision (award) is legally binding.

Real Indian Example

Your service agreement says 'all disputes shall be resolved by arbitration in Delhi.' This means you can't go to court directly — you'd need to go through an arbitrator first. Arbitration is usually faster and cheaper than court, but make sure the seat of arbitration is convenient for you.
