Plain English Definition

A registered symbol, word, or phrase that identifies and distinguishes a brand. Protected under the Trade Marks Act, 1999 in India. Registration gives exclusive nationwide rights for 10 years (renewable). Using ™ doesn't require registration; ® requires it.

Real Indian Example

You start a chai brand called 'ChaiWala.' You register the trademark. If someone else opens a shop with the same name, you can send a cease-and-desist notice and take legal action for trademark infringement.
